Man sentenced to 300 years in jail launched on technicality

GRAND JUNCTION, Colo. (KREX/CNN)– A Colorado guy sentenced to more than 300 years for kid sex criminal activities is now totally free, after a court threw away his conviction due to a technicality.

Michael Tracy McFadden, 46, was sentenced to more than 300 years in prison on charges he sexually attacked six young boys and women. On Tuesday, he was launched from the Arkansas Valley Correctional Facility.

McFadden appealed his conviction and claimed that hold-ups in his original trial broke Colorado’s speedy trial statutes. A rapid trial implies the offender should be tried for the supposed criminal activities within a reasonable time after being jailed. The state’s court of appeals ruled in McFadden’s favor as well as said he might not be retried.

District Lawyer Dan Rubenstein stated the outcome is something he never ever saw coming.

“Honestly I’m entirely appalled with the choice,” Rubenstein stated. “I find it offensive that our justice system would permit this to happen.”

Inning accordance with Rubenstein, there are two types of rapid trials: constitutional and statual. With a constitutional fast trial, there is no time frame depending upon the case. However in Colorado, statutory speedy right trials require an amount of time of 6 months.

“We petitioned for cert through the attorney general’s office who does our criminal appeals, petitioned for cert to the Supreme Court to see if they would reverse the Court of Appeals. They chose not to hear the case, and left the Court of Appeals decision last,” Rubenstein stated.

And since of that choice, McFadden was released from prison, leaving numerous households in the area outraged.

“The justice system completely stopped working in this circumstance, and you’ve heard the phrase before got off on a technicality?” Rubenstein said.”This is that situation to the most stark sense I’ve ever seen it.”
