A look at what the FBI'' s Kavanaugh investigation will involve

Image

Andrew Harnik, Swimming Pool/ AP Supreme Court nominee Brett Kavanaugh testifies prior to the Senate Judiciary Committee on Capitol Hill in Washington, Thursday, Sept. 27, 2018.

Saturday, Sept. 29, 2018|9:15 a.m.

WASHINGTON (AP)– President Donald Trump has purchased the FBI to resume Supreme Court candidate Brett Kavanaugh’s background examination after several women implicated him of sexual misbehavior. Simply exactly what the FBI will examine remains a mystery.

The Senate Judiciary Committee asked the White House to ask the FBI to perform the supplemental investigation, which will be “limited to present credible accusations” and need to be done by Oct. 5.

An FBI spokesperson did not instantly respond to questions about the investigation, including the number of representatives would be appointed and whether it could be finished in a week.

A look at what a resumed FBI examination would and would not do:

WHAT IS THE FBI’S FUNCTION?

The FBI carries out background checks for federal nominees but does not make judgments on the reliability or significance of accusations.

Private investigators put together details about a nominee’s past and provide findings to the firm that asked for the background check; in this case, it’s the White House. The info would be added to the nominee’s background file, which is readily available to senators.

Typically, background examinations do not return decades, but that’s what is required in Kavanaugh’s case due to the fact that the allegations are about incidents stated to have actually taken place during his teenage years. Kavanaugh is now 53.

COULD THE FBI INVESTIGATION BRING CLEARNESS TO WHAT OCCURRED?

Possibly. The FBI has broad discretion in determining the scope of the investigation.

The committee questioned Kavanaugh and among his accusers, Christine Blasey Ford during a hearing Thursday; other potential witnesses have submitted sworn declarations. FBI representatives might talk to the other accusers and witnesses and collect additional proof or information.

David Gomez, a previous FBI counterterrorism manager in Seattle, said officials at FBI head office generally will divide up leads that get designated to different field offices across the country for further investigation and will set a fast due date. The regional offices generally will appoint as numerous staff as required to pursue those leads.

An excellent representative, he stated, “would deal with Kavanaugh’s habits and behavior and trustworthiness during his high school years.”

Kavanaugh’s high school friend, Mark Judge, who Ford says remained in the room when an inebriated Kavanaugh sexually assaulted her, stated Friday that he will work together with any police that will “confidentially examine” sexual misconduct allegations against him and Kavanaugh.

Both Judge and Kavanaugh have vehemently denied any allegation of misconduct.

Lawyers for PJ Smyth and Leland Ingham Keyser, 2 others who Ford said were in your home when she was attacked, have said their customers want to work together “totally” with the FBI’s investigation.

CAN AN EXAMINATION BE DONE IN A WEEK?

Experts state the work can be done in a matter of days in most circumstances.

Ron Hosko, a former FBI assistant director, stated background examinations done by the bureau typically have brief turn-around times since the asking for agency needs the information quickly in order to decide on the nominee.

The FBI can not require somebody to speak with them as part of the process.

” Based on what we publicly know as far as deep space of individuals, I don’t see any reason the FBI could not finish an examination within one week,” said Mark Zaid, a Washington legal representative and specialist in security clearance and background examinations. “Keep in mind, they’re not reaching a choice or recommendation. They are simply compiling the investigation and reporting on it.”

WHAT DOES KAVANAUGH SAY ABOUT THIS?

Kavanaugh would not address directly when he was asked Thursday if he would agree to an FBI investigation, but stated he would do whatever the Judiciary Committee wanted.

In a declaration released by the White House on Friday, Kavanaugh said he was spoken with by the FBI throughout the selection process and participated in several background calls with the Senate.

” I have actually done whatever they have asked for and will continue to comply,” he said.

Image

Damian Dovarganes/ AP Los Angeles County Sheriff’s Department Homicide Bureau Capt. Christopher Bergner, left, looks on as Lt. John Corina, right, talks about the most current information of the Natalie Wood death examination at a news conference in Los Angeles, Monday, Feb. 5, 2018.

Monday, Feb. 5, 2018|5:10 p.m.

LOS ANGELES– Detectives hope the restored interest in the mystical 1981 drowning death of starlet Natalie Wood will bring forward brand-new witnesses who provide the details needed to figure out if the case was a criminal offense or terrible accident. If not, it might be the end of the investigation, a Los Angeles County constable’s authorities stated Monday

For almost four years, speculation has swirled around the death of the 43-year-old starlet who was chosen for three Academy Awards and starred in “West Side Story” and “Rebel Without a Cause.” She was on a yacht with her spouse, actor Robert Wagner, star Christopher Walken and the boat captain on Thanksgiving weekend of 1981. After a night of drinking, her body was found floating in the waters off Southern California’s Catalina Island.

Detectives at first ruled her death as an unintentional drowning. However the case was resumed in 2011 to see whether Wagner or anybody else contributed after the boat’s captain stated he heard the couple arguing the night of her disappearance. The coroner’s office later changed Wood’s death certificate to include “drowning and other undetermined factors.”

Investigators have actually reclassified Wood’s drowning as a “suspicious death” and state Wagner is a person of interest in the case. However the evidence gathered so far hasn’t reached the limit for a murder examination and there are no immediate strategies to submit criminal charges, investigators said Monday.

Numerous brand-new witnesses have actually come forward because the case was resumed, including one who described hearing shouting and crashing noises originating from the couple’s stateroom, authorities stated. Soon after that, separate witnesses who were on a boat that remained in the water nearby, heard a males and female arguing on the back of the boat and think the voices were those of Wood and Wagner, inning accordance with detectives.

Those witnesses corroborated the account of the boat’s captain, Dennis Davern, who had informed investigators he heard Wood and Wagner arguing in their cabin on the boat and went to check on them. When he went to their cabin, Wagner informed him to disappear prior to Wagner and Wood wound up arguing on the back of the boat, constable’s murder Lt. John Corina said Davern informed private investigators.

” He was the last individual with her, arguing, before everything went peaceful,” Corina stated of Wagner. “He’s an individual of interest due to the fact that he was the last individual with her prior to she went in the water.”

Wagner just talked to detectives after the drowning in 1981 and although detectives have aimed to question him numerous time because they reopened examination, he has refused, Corina said.

Wagner’s initial statement about exactly what took place and subsequent remarks about the case “really do not amount to exactly what we discovered,” Corina stated.

Wagner has actually rejected any involvement in Wood’s death and his attorney has stated he completely cooperated with detectives.

The star’s press agent, Alan Nierob, stated investigators have not contacted Wagner, now 87, in more than 5 years however declined to comment even more on the case. Sheriff’s officials would not say Monday when they last tried to get in touch with Wagner.

Time has actually been the largest barrier in the probe and the original investigator and much of the witnesses have died, Corina stated.

” We’re doing our last shot here, seeing if anyone else comes forward with any info,” he said. “When the suggestions all dry up, then I think we carry on to the next case.”

Trump attorney states president not under investigation

Image

Andrew Harnik/ AP Secretary of State Rex Tillerson, left, and White House Senior citizen Consultant Jared Kushner listen as President Donald Trump speaks during a Cabinet meeting, Monday, June 12, 2017, in the Cabinet Room of the White Home in Washington.

Sunday, June 18, 2017|4 p.m.

WASHINGTON– A member of the president’s outdoors legal group said Sunday that Donald Trump is not under federal examination, days after Trump appeared to confirm he was with a tweet about being the target of a “witch hunt.”

Appearing on a series of morning news programs, lawyer Jay Sekulow consistently stressed that “the president has not been and is not under investigation.” He stated a Friday tweet from Trump was specifically directed at a story in The Washington Post about the broadening probe into Russia’s election meddling.

As proof, Sekulow stated that Trump has not been informed of any investigation. He likewise mentioned the testimony from former FBI Director James Comey before the Senate intelligence committee, in which Comey stated he had informed Trump he was not under examination in the months preceeding his May 9 shooting.

Inquired about the possibility that an examination has actually considering that established and the president just does unknown, Sekulow said: “I can’t read people’s minds, however I can tell you this, we have not been alerted that there’s an examination to the president of the United States. So that– absolutely nothing has altered in that regard considering that James Comey’s testimony.”

The Post reported last week that Robert Mueller– the special counsel designated to investigate Russian involvement in the 2016 presidential election– was checking out whether Trump obstructed justice. Mueller was selected by Deputy Attorney general of the United States Rod Rosenstein and has extensive powers to probe any matters that develop from his initial investigation.

The president composed on Twitter Friday: “I am being investigated for shooting the FBI Director by the guy who informed me to fire the FBI Director! Witch Hunt.”

“Witch hunt” has ended up being Trump’s favored expression to dismiss the probe into Russian election interference. The message apparently referred to Rosenstein, whose role leading the federal examination has actually ended up being increasingly made complex. The White House used a memo he wrote to justify Trump’s choice to fire Comey, but Trump’s firing of the FBI director may now become part of the probe.

The president has actually denied that he has any nefarious ties to Russia and has likewise contested that he’s tried to obstruct the investigation into his project’s possible role in Russia’s election-related hacking.

The president has directed a few of his disappointment at Rosenstein and Mueller. Sen. Marco Rubio stated Sunday that he does not anticipate Trump to seek to fire them.

“I don’t believe it’s going to take place,” stated Rubio on CNN’s “State of the Union.” “The best thing that could take place for the president, and the country, is a full and trustworthy examination.”

Trump is under pressure to reveal whether he has any tape recordings of private discussions with Comey. Rep. Adam Schiff, the top Democrat on the Home intelligence committee, stated that the panel– overseeing among several congressional examinations– is looking forward to getting an action from the White House on whether recordings exist.

The president suggested on Twitter that he might have taped those conversations. Schiff said he desires the White House to acknowledge the tapes or make clear there are no tapes and “it was an idle threat.”

The committee sent out a bipartisan letter this month to White House counsel Don McGahn looking for a response by this Friday. It also sent out a letter to Comey asking for any notes or memos. Schiff stated if the panel can’t get a response then he believes a subpoena will be required.

Schiff also said he believes recent congressional testimony from Comey and Chief law officer Jeff Sessions points to indications of possible blockage by Trump that warrant further investigation. Schiff cited that the president at one meeting “cleared the space” of advisors and asked to speak with Comey alone. Comey testified to Congress that Trump then asked him to back off the examination into his fired nationwide security consultant, Michael Flynn.

“That signifies this president knew all too well that it was improper,” Schiff stated.

And Senate intelligence committee member Sen. Angus King, an independent from Maine, worried that the probe will likely last for a very long time. King stated the “collusion, the cooperation aspect of the examination is not over.” He included: “A great deal of people have stated, ‘When do you think you’ll be done?’ Perhaps completion of the year. This is a very intricate matter, involving thousands of pages of intelligence files, great deals of witnesses. There’s a great deal of details yet to go.”

While aides have actually encouraged Trump to stay off Twitter, the president continued to weigh in Sunday as he invested the weekend at Camp David, the government-owned presidential retreat in Maryland.

In a two-part tweet posted prior to 7 a.m., Trump composed: “The MAKE AMERICA GREAT AGAIN program is doing effectively despite the diversion of the Witch Hunt.”

Sekulow appeared on NBC’s “Fulfill journalism,” CNN’s “State of the Union,” CBS’s “Face the Country” and “Fox News Sunday” on Fox. Rubio spoke on NBC, CNN and CBS. Schiff spoke on ABC’s “Today”and King spoke on NBC.
